Terms and Conditions

1. Who you are contracting with

KongInsight is operated by Nguyen Manh Cuong, a sole trader trading as KongInsight (“we”, “us”). You can reach us at manhcuongincusar@gmail.com.

The service is currently free and no paid plans are on sale. If we introduce paid plans, orders will be fulfilled by Paddle.com Market Ltd, acting as our authorised reseller and merchant of record: Paddle would be the seller of record for your purchase, handle payment and any applicable taxes, appear on your card statement and invoice, and your purchase would also be subject to Paddle's buyer terms.

2. What this service is

KongInsight is a web application. It displays Hong Kong buildings, land lots, land-use zoning and statutory height limits on a map, renders government 3D building models, and computes sunlight and shadow for a date and time you choose. All output is generated automatically by software from public Hong Kong government open data.

3. Accounts and access

• No account is needed. Every part of the application — every map layer, the 3D models, sun and shadow, and the detail card for any building, lot or zone — is open to anyone who visits.
• There is no usage limit on individual use. Automated or bulk use is a different matter — see section 6.

4. Plans, billing and cancellation

• The service is currently free. There is nothing to buy, nothing to cancel and no payment authorisation is stored.
• We may introduce paid plans later. If we do, they will be listed on the Pricing page with prices in HKD and USD, the billing terms will be stated there before anything is charged, and these terms will be updated with notice. What is free today will not silently become paid.

5. Refunds

Nothing is charged today, so there is nothing to refund. Any future purchase will be covered by a 30-day money-back guarantee, no questions asked — see the Refund Policy.

6. Acceptable use

You agree not to:

• scrape, bulk-download or systematically extract the map tiles, 3D models or computed results, or use automated tools against the service;
• resell, sublicense or redistribute the service or its output as a competing data product;
• circumvent technical measures that protect the map data, or attempt to access parts of the system you were not granted;
• use the service unlawfully, including in ways that breach the Hong Kong Personal Data (Privacy) Ordinance.

We may suspend access that is damaging the service or breaching these terms. Where the breach is not deliberate, we will contact you first.

7. Data sources and accuracy

Source data comes from the Hong Kong Government — the Lands Department, CSDI and data.gov.hk — and remains © The Government of the Hong Kong Special Administrative Region. It is republished under the terms those departments set for their open data.

Government datasets contain errors, gaps and outdated records, and our calculations are estimates derived from them. Recorded storey counts, for example, are known to disagree with the physical building in some cases. The service is provided “as is”: we do not warrant that any figure is accurate, complete or current.

8. Intellectual property

The application, its interface, code and the analysis it generates belong to us. You have a personal, non-transferable right to use the service for your own research. Underlying government data remains the property of its publishers.

9. Availability and changes

We aim to keep the service running but do not guarantee uninterrupted availability; it may be unavailable for maintenance, upstream data outages or reasons outside our control. We may add, change or remove features. If we ever discontinue a paid plan you have already paid for, we will refund the unused portion.

10. Termination

You may stop using the service at any time. We may terminate access for a material breach of these terms; if we ever do so without cause while you are on a paid plan, we refund the unused portion of your current period.

11. Liability

To the extent permitted by law, our total liability arising from the service is limited to the amount you paid us in the 12 months before the claim — which, for a free service, is nil. We are not liable for indirect or consequential loss, including lost profit or any loss arising from a property decision made using the service. Nothing here excludes liability that cannot be excluded by law.

12. Changes to these terms

We may update these terms. The current version is always on this page with its update date. If a change materially affects paying customers (should we have any), we email them before it takes effect.

13. Governing law

These terms are governed by the laws of the Socialist Republic of Vietnam, where the seller is resident. This does not remove consumer rights you have under the law of your own country of residence.
